General Terms and Conditions (GTC)

1. Scope of Application

The following General Terms and Conditions (GTC) apply to all orders placed via our online shop. Our online shop is exclusively aimed at consumers.

For Germany: A consumer pursuant to § 13 BGB (German Civil Code) is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession.
For Austria: In the following terms, a "consumer" is to be understood as a "consumer" (Konsument) within the meaning of the Austrian Consumer Protection Act (KSchG).
For Switzerland: In the following terms, a "consumer" is to be understood as a "consumer" according to Swiss law.

2. Contracting Parties, Conclusion of Contract, Correction Options

The purchase contract is concluded with George Jabbour (Jabbour E-Retail).

By placing the products in the online shop, we make a binding offer to conclude a contract regarding these items. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded by clicking the order button, which indicates your acceptance of the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract Language, Storage of Contract Text

The language available for the conclusion of the contract is: German.

We store the text of the contract and forward the order data and our GTC to you in text form. You can view the contract text in our customer login area.

4. Prices and Delivery Terms

Due to the small business regulation (Kleinunternehmerregelung) pursuant to § 19 UStG (German Value Added Tax Act), no VAT is charged and consequently not shown on the invoice. All stated prices are final prices.

Shipping costs may be added to the stated product prices. You can find more detailed information about possible shipping costs in the product offers.

We only deliver by dispatch. Unfortunately, it is not possible to collect the goods yourself. We do not deliver to parcel stations (Packstationen).

5. Payment

In our shop, the following payment methods are generally available to you via the service provider Shopify Payments and other affiliated partners:

Credit Card: By submitting the order, you provide your credit card details. Your card will be charged immediately after placing the order.
PayPal: In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further instructions during the ordering process.
Sofort by Klarna: In order to pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, Germany, you must have a bank account activated for online banking, identify yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. You will receive further instructions during the ordering process.
Google Pay: In order to pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay function, identify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after the order is placed. You will receive further instructions during the ordering process.
Apple Pay: In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, identify yourself with your access data, and confirm the payment instruction. The payment transaction is carried out immediately after the order is placed. You will receive further instructions during the ordering process.
Klarna: In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available for consumers. Unless otherwise stated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will receive further instructions with the respective payment option and during the ordering process.
- Purchase on account via Klarna: The invoice amount is due 30 days after dispatch of the goods and receipt of the invoice.
- Installment purchase via Klarna: You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment amount is EUR 6.95.
- Klarna Credit Card: You provide your credit card details during the ordering process. Your card will be charged by Klarna immediately after the order is placed. An address and credit check will not take place.

6. Retention of Title

The goods remain our property until full payment is made. For customers based in Switzerland, we are entitled to make a corresponding entry in the retention of title register.

7. Warranty and Guarantees

7.1 Statutory Liability for Defects The statutory rights of liability for defects apply. For consumers based in Switzerland, the following applies: You shall inspect the condition of the received goods as soon as it is feasible in the normal course of business and, if defects appear for which the seller is liable under warranty, notify the seller immediately. If the consumer fails to do so, the purchased goods shall be deemed approved, unless the defects were not recognizable during the customary inspection. If such defects appear later, the notification must be made immediately after discovery; otherwise, the goods shall also be deemed approved with regard to these defects. Return the defective product to us with a description of the defect. You bear the applicable transport costs. We provide warranty by remedying defects. At our discretion, this is done either by eliminating the defect (repair) or by delivering a defect-free item (replacement). If the supplementary performance fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a price reduction is excluded.

7.2 Guarantees and Customer Service Information on any applicable additional guarantees and their exact conditions can be found with the respective product and on special information pages in the online shop.

8. Liability

For claims based on damage caused by us, our legal representatives, or vicarious agents, we always have unlimited liability:

in the event of injury to life, limb, or health,
in the event of intentional or grossly negligent breach of duty,
in the case of guarantee commitments, where agreed, or
insofar as the scope of application of the Product Liability Act (Produkthaftungsgesetz) is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
